A Federal High Court, in Awka the capital of Anambra State has issued a ruling demanding that Isuofia Microfinance Bank Limited and the police compensate Ohadugha Chizara, a nursing mother with the amount of N2.2 million. This compensation is for the arrest and detention of both Chizara and her six month old baby at the Okpoko police cell.
The case with suit number FHC/Awka/CS/121/2022 involved Ohadugha Chizara as the applicant and Isuofia Microfinance Bank Ltd Nwafor Okechukwu Nwoke Ifeoma, Commissioner of Police Anambra State Ugochukwu Ugbo, Divisional Police Officer Okpoko and Inspector Chinelo Okechi (I.P.O) as respondents.
The applicants counsel, F.N Asogwa Esq from His Grace Chambers presented a plea to the court on behalf of their clients rights. They requested an order for the respondents to pay their client a sum of N100 million as compensation along with damages.
These damages are also related to infringements on Chizaras rights to life dignity as a being, personal liberty and freedom of movement between June 22nd and June 24th at Okpoko Police cell, in Anambra State.
The applicant also requested the court to award her client N50 million as damages for "violating, infringing and breaching her clients right, to life."
The counsel also urged that the respondents and their associated individuals or groups be prohibited from "violating, infringing and breaching her clients rights, to life human dignity, personal liberty and freedom of movement as guaranteed by the constitution." Additionally they sought reliefs.
On Friday the Presiding Judge, Justice F. I. Riman made a ruling instructing the Police, the bank, Nwafor Okechukwu and Nwoke Ifeoma to compensate the nursing mother with the sum of N2m.
The Judge also ordered the respondents to pay an amount of two hundred thousand naira (N200,000) as damages, for violating and infringing upon the applicants fundamental rights from June 22nd to June 24th at Okpoko Police Station where he was held in custody.
Furthermore the court granted an injunction preventing the respondents, their associates or representatives from violating and infringing upon Chizaras rights to life dignity of beings, personal freedom and freedom of movement as guaranteed by Nigerias 1999 constitution.
Chizara was detained due, to a loan transaction.
